Welcome to Bhikhaari.in (“Bhikhaari.in”, “Platform”, “Website”, “we”, “us”, or “our”).

Bhikhaari.in is designed as a social-support platform that provides a simple and informal way for individuals to voluntarily help people who may be in financial or other genuine need.

The Platform is intended to facilitate voluntary assistance between users and intended beneficiaries. Contributions are voluntary and are not investments, loans, purchases or financial products.

By accessing, browsing or using Bhikhaari.in, you acknowledge that you have read, understood and agreed to these Terms of Use.

Purpose and Nature of Bhikhaari.in

Bhikhaari.in is created as a social-purpose, non-commercial platform intended to facilitate voluntary assistance to individuals who may be in need.

The Platform may allow individuals to:

  • create or submit assistance requests;
  • describe their circumstances or requirements;
  • receive voluntary financial assistance from other users;
  • discover people seeking assistance; and
  • voluntarily contribute to a beneficiary.

Bhikhaari.in does not represent that every person appearing on the Platform is independently verified in every respect.

The Platform may conduct reasonable checks or verification where feasible, but third-party information may not always be completely accurate, current or independently verifiable.

Legal Status of the Platform

Unless expressly stated otherwise, Bhikhaari.in should not be understood merely from its operation as:

  • a charitable trust;
  • an NGO;
  • a Section 8 company;
  • a government organisation;
  • a religious organisation;
  • a bank;
  • a financial institution;
  • an investment platform;
  • a lending platform;
  • a payment wallet;
  • an insurance provider; or
  • a tax-exempt charitable institution.

The legal status of the entity/person operating Bhikhaari.in shall be determined by its actual registration and applicable law.

Nothing on the Platform should be interpreted as a representation that contributions made through Bhikhaari.in automatically qualify for any tax deduction or charitable benefit.

Voluntary Contributions

All contributions made through or in connection with Bhikhaari.in are completely voluntary.

A Donor independently decides:

  • whether to contribute;
  • how much to contribute;
  • whom to support; and
  • whether the information available is sufficient to make a contribution.

No person is required to contribute to any beneficiary.

A contribution does not create an expectation of:

  • financial return;
  • repayment;
  • interest;
  • ownership;
  • profit;
  • reward; or
  • any other financial benefit.

A contribution is not an investment or loan unless a separate legally valid agreement expressly states otherwise.

Maximum Request Limit — ₹1,00,000

Bhikhaari.in has a strict Platform-level limit of:

₹1,00,000 (Indian Rupees One Lakh Only) per assistance request.

No individual assistance request, campaign or listing on Bhikhaari.in may request, solicit or represent a requirement exceeding ₹1,00,000.

The ₹1,00,000 limit is a Platform policy.

It does not mean that the beneficiary’s actual financial requirement is limited to ₹1,00,000.

For example, if a person’s actual financial requirement is ₹3,00,000, the person cannot create a Bhikhaari.in request asking for ₹3,00,000. The maximum permitted request on the Platform remains ₹1,00,000.

The Platform does not guarantee that a beneficiary will receive ₹1,00,000.

The actual amount received may be:

  • less than ₹1,00,000;
  • equal to ₹1,00,000; or
  • zero,

depending on voluntary contributions received.

No Circumvention of the ₹1,00,000 Limit

Users must not attempt to circumvent the ₹1,00,000 maximum by:

  • creating multiple substantially identical requests;
  • creating multiple accounts;
  • dividing one requirement into several artificial requests;
  • using different names for the same underlying requirement;
  • asking another person to create a related request; or
  • using any other method intended to bypass the Platform limit.

If Bhikhaari.in reasonably believes that multiple requests relate to the same underlying need or are being used to circumvent the limit, Bhikhaari.in may:

  • reject the request;
  • combine or remove related requests;
  • suspend the relevant account;
  • remove the content;
  • restrict future requests; or
  • take other reasonable action permitted by law.

No Guarantee of Donations

Bhikhaari.in does not guarantee that any beneficiary will receive any particular amount.

Publication of a request does not mean that:

  • Bhikhaari.in endorses the beneficiary;
  • Bhikhaari.in guarantees the beneficiary’s circumstances;
  • the requested amount will be collected;
  • the beneficiary will receive the requested amount; or
  • the beneficiary’s circumstances will improve.

A request appearing on the Platform should not be interpreted as a promise by Bhikhaari.in to provide financial assistance.

Information Provided by Beneficiaries

Beneficiaries or users may provide information relating to their circumstances, including:

  • financial difficulties;
  • employment;
  • family circumstances;
  • education;
  • medical circumstances;
  • photographs;
  • location;
  • personal experiences;
  • requested amount; and
  • intended use of assistance.

Such information may originate from the beneficiary or another third party.

Users are responsible for ensuring that information submitted by them is truthful, accurate and not misleading.

Submitting false, fabricated, misleading or fraudulent information is strictly prohibited.

Verification Disclaimer

Bhikhaari.in may perform reasonable verification or moderation checks.

However, verification may be limited by:

  • availability of information;
  • technical limitations;
  • third-party information;
  • inability to independently verify every statement;
  • privacy restrictions;
  • time limitations; and
  • other circumstances beyond the Platform’s reasonable control.

Accordingly, verification should not be interpreted as an absolute guarantee of authenticity.

A “verified” or similar designation, if used, means only that certain checks were performed according to the Platform’s applicable process. It does not constitute a guarantee of every fact, statement or future circumstance concerning the beneficiary.

Donor’s Independent Decision

Before contributing, Donors should independently evaluate the information available to them.

A Donor is responsible for deciding whether to contribute.

Bhikhaari.in does not provide a guarantee regarding the truthfulness of every third-party statement and cannot guarantee the future conduct of any beneficiary.

By voluntarily contributing, the Donor acknowledges and accepts the inherent risks associated with providing assistance to another person through an online platform.

Direct Assistance to the Beneficiary

Where technically and legally feasible, Bhikhaari.in may facilitate a mechanism through which financial assistance is transferred directly to the intended beneficiary using a bank account, UPI, payment gateway or other permitted payment mechanism.

Where funds are transferred directly from a Donor to a beneficiary through a third-party payment service:

  • Bhikhaari.in may not take custody of the funds;
  • Bhikhaari.in may not own the funds;
  • Bhikhaari.in may not control the beneficiary’s bank account;
  • the payment may be processed by an independent payment service provider; and
  • the transaction may be subject to the terms and policies of that provider.

Where Bhikhaari.in itself receives or handles any funds, the treatment of those funds shall be governed by the applicable payment arrangement and applicable law.

Third-Party Payment Providers

Payments may be processed through independent third-party services, including banks, UPI providers, payment gateways and other authorised payment service providers.

Bhikhaari.in does not control the independent infrastructure, availability, security or policies of third-party payment providers.

Payment failures, delays, reversals, chargebacks, bank restrictions or technical issues may occur.

Users may also be required to comply with the applicable terms and verification requirements of the relevant payment provider.

Misuse and Fraud

The following activities are strictly prohibited:

  • impersonation;
  • fabricated identities;
  • fake beneficiaries;
  • false financial claims;
  • fraudulent medical or personal claims;
  • submission of forged documents;
  • misleading photographs or information;
  • collecting money for an undisclosed purpose;
  • using another person’s identity without permission;
  • fraudulent payment requests;
  • money laundering or other unlawful financial activity;
  • attempting to circumvent the ₹1,00,000 request limit; and
  • any other unlawful or deceptive conduct.

If Bhikhaari.in receives credible information indicating fraud, abuse or unlawful activity, it may take reasonable action, including removal, suspension, restriction, investigation and cooperation with lawful authorities.

Beneficiary Responsibility

Every beneficiary is solely responsible for:

  • the truthfulness of their request;
  • the documents and information submitted;
  • the purpose for which assistance is requested;
  • complying with applicable laws; and
  • their use of any funds received.

A beneficiary must not represent Bhikhaari.in as guaranteeing their circumstances, identity or request unless Bhikhaari.in has expressly authorised such representation.

Use of Contributions

Beneficiaries are expected to use contributions consistently with the purpose represented to Donors and in accordance with applicable law.

Bhikhaari.in does not continuously control or supervise how a beneficiary spends money after the beneficiary receives it unless a specific arrangement or legal obligation requires otherwise.

Bhikhaari.in therefore does not guarantee the ultimate use of funds by a beneficiary after transfer.

Where credible evidence of misuse is received, Bhikhaari.in may take reasonable action available to it.

No Tax Deduction / 80G Guarantee

Unless expressly stated otherwise and legally applicable, contributions made through Bhikhaari.in should not be treated as automatically eligible for deduction under Section 80G or any other tax provision.

Bhikhaari.in does not guarantee any tax benefit to a Donor.

A Donor must not claim a tax deduction solely because a contribution was made through Bhikhaari.in.

Any tax treatment depends on:

  • the legal status of the recipient;
  • the nature of the contribution;
  • applicable tax laws;
  • required documentation; and
  • other statutory conditions.

Users should obtain independent tax advice where required.

No Profit Representation

Bhikhaari.in is intended to operate as a non-profit / non-commercial social-support initiative to the extent represented by its operator and permitted by its actual legal structure.

Bhikhaari.in does not intend to represent that contributions are investments or that the Platform guarantees any financial return.

If any legitimate payment-processing fee, banking charge, technology expense, statutory charge or other applicable expense is imposed in connection with a transaction, the applicable arrangement should be disclosed to users where reasonably practicable.

The exact legal and tax treatment of the Platform depends upon the legal entity and operating structure of Bhikhaari.in.

Platform Fees

Unless expressly disclosed on the relevant transaction page:

Bhikhaari.in does not represent that it will deduct a percentage of a voluntary contribution as a personal profit or commission.

Third-party payment processors, banks or other service providers may independently charge applicable fees.

Where Bhikhaari.in introduces any fee or deduction, the relevant amount or basis should be disclosed before the user completes the applicable transaction, subject to technical and legal requirements.

Third-Party Content

The Platform may contain content submitted by users or beneficiaries.

Such content may include:

  • text;
  • photographs;
  • videos;
  • documents;
  • personal stories;
  • financial information;
  • links; and
  • other user-generated material.

Third-party content does not necessarily represent the views or opinions of Bhikhaari.in.

Bhikhaari.in may moderate or remove content in accordance with these Terms and applicable law.

Prohibited Content

Users must not upload or publish content that:

  • is knowingly false or fraudulent;
  • is defamatory or unlawfully harmful;
  • infringes another person’s intellectual-property rights;
  • violates privacy rights;
  • contains malicious software;
  • impersonates another person;
  • promotes unlawful activity;
  • contains threats or harassment;
  • exploits children or vulnerable persons;
  • is sexually exploitative;
  • contains stolen or unlawfully obtained personal information;
  • attempts to manipulate or defraud Donors; or
  • otherwise violates applicable law.

Right to Remove or Suspend

Bhikhaari.in reserves the right, subject to applicable law, to:

  • reject a request;
  • remove content;
  • suspend an account;
  • restrict access;
  • disable a profile;
  • investigate suspicious activity;
  • prevent further requests;
  • remove duplicate or misleading requests; and
  • cooperate with competent authorities.

These actions may be taken where Bhikhaari.in reasonably believes that content or conduct:

  • violates these Terms;
  • may be fraudulent;
  • may be unlawful;
  • may create a risk to users;
  • may violate another person’s rights; or
  • may compromise the safety or integrity of the Platform.

Reporting Fraud or Abuse

Any user who suspects:

  • fraud;
  • impersonation;
  • false information;
  • misuse of funds;
  • duplicate requests;
  • suspicious activity; or
  • other unlawful behaviour

should report it to Bhikhaari.in through the designated reporting or contact mechanism.

Reports should contain sufficient information to enable a reasonable investigation.

Bhikhaari.in may investigate reports based on the information reasonably available to it.

No Guarantee of Platform Availability

Bhikhaari.in may occasionally experience:

  • downtime;
  • maintenance;
  • technical errors;
  • server failures;
  • network failures;
  • payment-provider outages;
  • security incidents; or
  • other interruptions.

Bhikhaari.in does not guarantee uninterrupted or error-free availability of the Platform.

Security

Bhikhaari.in may implement reasonable technical and organisational measures intended to protect the Platform and information processed through it.

However, no online platform can guarantee absolute security.

Users acknowledge that Internet-based services involve inherent security risks.

Users must also protect their own passwords, authentication credentials, OTPs and devices.

Bhikhaari.in will never intentionally require users to disclose passwords or OTPs through public content.

Privacy and Personal Information

Bhikhaari.in may collect and process information necessary to operate the Platform, facilitate assistance requests, communicate with users, prevent abuse, maintain security and comply with legal obligations.

Personal information will be handled in accordance with the Platform’s Privacy Policy and applicable data-protection laws.

Users should not unnecessarily publish:

  • passwords;
  • OTPs;
  • complete bank credentials;
  • card PINs;
  • authentication secrets;
  • highly sensitive identity information; or
  • another person’s private information

on public areas of the Platform.

The applicable privacy framework may include the Digital Personal Data Protection Act, 2023 and applicable rules/notifications as and when relevant to the Platform’s processing activities.

Children’s Information

Users must not create requests or submit information relating to a child without appropriate lawful authority, consent or other legal basis where required.

Bhikhaari.in may take additional precautions where content appears to involve children or vulnerable individuals.

Intellectual Property

Unless otherwise stated, the Website’s software, design, layout, branding, logo, original text, graphics and other original materials belong to or are lawfully used by Bhikhaari.in and are protected by applicable intellectual-property laws.

Users may not reproduce, distribute, modify or commercially exploit Platform materials without appropriate permission, except where permitted by law.

User Licence for Submitted Content

By submitting content to Bhikhaari.in, a user grants Bhikhaari.in the permissions reasonably necessary to host, display, reproduce, format, moderate and distribute that content for operating and promoting the Platform, subject to applicable law and the Platform’s Privacy Policy.

The user represents that they have the necessary rights and permissions to submit the content.

Users should not submit another person’s photograph, personal information or copyrighted material without appropriate permission or lawful basis.

No Professional Advice

Information available on Bhikhaari.in is provided for general informational and social-support purposes.

Nothing on the Platform constitutes:

  • legal advice;
  • medical advice;
  • financial advice;
  • investment advice;
  • tax advice;
  • insurance advice; or
  • any other professional advice.

Users should obtain independent professional advice where appropriate.

Limitation of Liability

To the maximum extent permitted by applicable law, Bhikhaari.in, its lawful owner/operator, employees, representatives, contractors and service providers shall not be liable for indirect, incidental, special, consequential or punitive losses arising from matters including:

  • third-party information;
  • fraudulent conduct of a user or beneficiary;
  • disputes between Donors and beneficiaries;
  • misuse of contributions by a beneficiary after transfer;
  • payment-provider failures;
  • bank or UPI failures;
  • temporary Website unavailability;
  • technical failures beyond reasonable control;
  • unauthorised third-party conduct;
  • reliance upon third-party information; or
  • circumstances beyond Bhikhaari.in’s reasonable control.

Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under applicable Indian law.

No Waiver of Legal Rights

Nothing in these Terms is intended to:

  • waive rights that cannot legally be waived;
  • prevent a competent authority from exercising its statutory powers;
  • prevent a user from exercising a mandatory legal right; or
  • provide immunity from liability for fraud, wilful misconduct or other liability that cannot legally be excluded.

These Terms are intended to define the relationship between the Platform and its users to the maximum extent permitted by law.

Intermediary / Third-Party Information

To the extent Bhikhaari.in qualifies as an intermediary under applicable law, the Platform may rely on applicable statutory protections available to intermediaries, subject to satisfaction of the relevant statutory requirements and due-diligence obligations.

Bhikhaari.in does not claim automatic immunity from liability merely because third-party content appears on the Platform.

The Platform may take reasonable steps to comply with applicable legal obligations concerning unlawful content, complaints, notices and lawful governmental requests.

Lawful Requests and Cooperation

Bhikhaari.in may cooperate with:

  • courts;
  • law-enforcement authorities;
  • regulators;
  • payment providers;
  • cybersecurity authorities; and
  • other competent authorities

where required or permitted by applicable law.

Where legally permitted, relevant information may be preserved or disclosed in response to valid legal requests.

Complaints and Grievances

Users may submit complaints concerning:

  • fraudulent content;
  • privacy issues;
  • payment issues;
  • misuse;
  • inappropriate content;
  • account issues; or
  • other Platform-related matters

through the official contact/grievance mechanism published by Bhikhaari.in.

The Platform may request additional information reasonably necessary to investigate a complaint.

Third-Party Links and Services

Bhikhaari.in may contain links to third-party websites, payment services or other external services.

Bhikhaari.in does not control those third-party services and is not responsible for their independent:

  • content;
  • privacy policies;
  • security;
  • availability;
  • terms;
  • practices; or
  • transactions.

Users should review the applicable third-party terms before using external services.

User Accounts

Where user accounts are available, users must provide accurate information and must not:

  • create accounts for fraudulent purposes;
  • impersonate another person;
  • share authentication credentials;
  • create multiple accounts to circumvent Platform restrictions; or
  • allow another person to misuse their account.

Bhikhaari.in may suspend or terminate accounts involved in prohibited conduct.

Termination

Bhikhaari.in may suspend or terminate access to the Platform where permitted by law if a user:

  • violates these Terms;
  • engages in fraudulent activity;
  • attempts to circumvent Platform restrictions;
  • creates a security risk;
  • submits unlawful content; or
  • otherwise misuses the Platform.

Users may stop using the Platform at any time.

Certain provisions, including liability, intellectual property, dispute resolution and legal obligations, may continue to apply after termination where appropriate.

Changes to the Platform

Bhikhaari.in may modify, suspend, restrict or discontinue features of the Platform from time to time.

The Platform may also modify its rules, request limits, verification processes and technical features.

Material changes to these Terms may be communicated through the Website or other reasonable means where required.

Changes to the ₹1,00,000 Limit

The current maximum request limit is ₹1,00,000.

Bhikhaari.in may change this limit in the future subject to applicable law and Platform policy.

Unless otherwise stated, the limit applicable at the time a request is created shall govern that request.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws applicable in India.

Subject to applicable law, disputes concerning the Platform shall be subject to the jurisdiction of the competent courts having jurisdiction over the legal owner/operator of Bhikhaari.in.

Nothing in this clause prevents a person from approaching a forum or authority where such right is mandatorily provided by law.

Severability

If any provision of these Terms is determined by a competent court or authority to be invalid, unlawful or unenforceable, that provision shall be interpreted or modified to the minimum extent necessary, and the remaining provisions shall continue to the extent permitted by law.

Entire Agreement

These Terms, together with the Privacy Policy and any other policies expressly incorporated by reference, constitute the applicable terms governing use of Bhikhaari.in, subject to mandatory provisions of applicable law.

User Acknowledgement

By using Bhikhaari.in, you acknowledge and agree that:

  • Bhikhaari.in is intended as a social-support platform;
  • contributions are voluntary;
  • the maximum assistance request is ₹1,00,000;
  • Bhikhaari.in does not guarantee that a request will receive any contribution;
  • third-party information may not always be completely accurate;
  • verification does not constitute an absolute guarantee;
  • beneficiaries are responsible for information submitted by them;
  • fraudulent and unlawful use is prohibited;
  • payment services may be provided by independent third parties;
  • Bhikhaari.in does not automatically provide any tax deduction or 80G benefit;
  • Bhikhaari.in does not guarantee the ultimate use of funds after they are transferred to a beneficiary;
  • online services involve inherent technical and security risks; and
  • these Terms are subject to applicable Indian law.

Important legal disclaimer

Bhikhaari.in does not claim or guarantee that the Platform, its owner/operator, users or beneficiaries are immune from legal claims, complaints, investigations, proceedings or statutory action.

No disclaimer can lawfully prevent a competent authority or court from taking action where applicable law permits or requires it.

These Terms are intended to clearly communicate the nature of Bhikhaari.in, establish reasonable rules for users, define the responsibilities of beneficiaries and Donors, address third-party content and transactions, and limit liability only to the extent permitted by applicable law.

If any provision of these Terms conflicts with mandatory applicable law, the mandatory law shall prevail.
